  • Khaled Ghandour excels with affirmative defenses against Dr. Uwaydah’s Second Amended Complaint.  He argues truly appropriate doctrines of equitable estoppel and judicial estoppel.

Khaled Ghandour, a Lebanese businessman, who was sued by Dr. Munir Uwaydah in the year 2008, has retaliated with his Answer to a Second Amended Complaint from Uwaydah claiming the businessman owes him over $14,000,000.

Munir Uwaydah set up a bench trial in Santa Monica Superior Court in February of 2009, and brought in an actor to play Khaled Ghandour in the court room.  It was the most egregious example of court fraud that could ever be imagined.   What is more egregious and stunningly outrageous is that the court judge bought the whole charade.

Khaled Ghandour further argues in his Answer to Uwaydah’s Second Amended Complaint that the relief awardable was limited to Dr. Uwaydah’s demand at the December 7, 2009 proceedings and bench trial.  Uwaydah only demanded at most $1,000,000.  How could it be, then, that he was awarded $6,000,000 by the court?

That award was in favor of Dr. Uwaydah and his Prometheus Health Imaging, Inc. for $3,000,00 on the first and second causes of action, Unfair Competition and Misappropriation of Trade Secrets; then the Court awarded Uwaydah and Prometheus an additional $3,000,000 on the Third and Fourth causes of action for Malicious Prosecution and Libel.

So, these two sums added together come... Read More

When defense attorneys go overboard for their clients.  Lawyers Benjamin Gluck and Matthew Rifat went too far.

There are defense attorneys who believe insurance carriers are always coming up with tactics they can use not to pay claims.  One of them is to threaten medical providers with fraud.  And lawyers who are always pro-medical-provider, who have a prejudice in thinking it’s always the insurance company who’s the bad guy, can miss it...
